AGRISA PERSVERKLARING oor die ondertekening van die Onteieningswet

Privaat eiendom is die hoeksteen van landbouvolhoubaarheid envoedselsekerheid AgriSA is teleurgesteld oor die ondertekening van die Onteieningswetsontwerp op 23 Januarie 2025 deur president Cyril Ramaphosa. Die wetsontwerp fasiliteer die onteiening van grond met nul vergoeding onder bepaalde voorwaardes in die openbare belang. “Die ondertekening van die Onteieningswetsontwerp hou ‘n risiko in vir private eiendomsreg wat die primêre basis is waarop Suid-Afrikaanse landbou gestruktureer is. Gevolglik hou die wetsontwerp ‘n risiko in vir andbouvolhoubaarheid en voedselsekerheid. Daarom is AgriSA daartoe verbind om eiendomswaardes en -regte te verdedig en sal alle nodige hulpbronne in oorleg met regskundiges gebruik om hierdie beginsels te handhaaf,” sê Johann Kotzé, uitvoerende hoof van AgriSA. AgriSA het van 2013 tot 2020 aktief aan die NEDLAC en parlementêre prosesse deelgeneem en bygedra tot die 2016 Onteieningswetsontwerp wat die basis vir die onlangs ondertekende wetgewing gevorm het. AgriSA het op 29 April 2024 ‘n brief aan die President gerig waarin AgriSA hom versoek het om te oorweeg om sy grondwetlike bevoegdhede kragtens artikel 84(2)(b) en (c) uit te oefen. AgriSA het versoek dat die president óf die Onteieningswetsontwerp na die Nasionale Vergadering terugverwys vir heroorweging óf die Konstitusionele Hof raadpleeg vir ‘n beslissing oor die grondwetlikheid van die wetsontwerp voordat dit onderteken word. AgriSA het in sy brief die opdrag van ‘n onafhanklike ondersoek na die makro-ekonomiese impakbepaling van ‘n beleid van grondonteiening sonder vergoeding in Suid-Afrika deur GOPA Group South Africa (Edms) Bpk beklemtoon. “Hierdie assessering het AgriSA se jarelange oortuiging herhaal dat die bevordering van kapitaalvorming met privaat eiendomsreg verbind is en gevolglik ‘n deurslaggewende voorvereiste vir ekonomiese ontwikkeling, werkskepping en groei is,” sê Kotzé. “AgriSA ondersteun die behoefte aan transformasie en grondhervorming in die landbousektor, maar beklemtoon dat dit nie ten koste van die ekonomie en beleggersvertroue moet kom nie,” het Kotzé bygevoeg. Die organisasie bly toegewyd aan die beskerming van private eiendomsreg en die bevordering van die groei en stabiliteit van Suid-Afrika se landbousektor, terwyl voedselsekerheid vir almal verseker word. AGRISA PRESS RELEASE regarding the signing of the Expropriation Bill

Private property is the cornerstone of agricultural sustainability and food security AgriSA is disappointed by the signing of the Expropriation Bill into law by President Cyril Ramaphosa on January 23, 2025. The bill facilitates the expropriation of land with nil compensation under specified conditions in the public interest. “The signing of the Expropriation Bill poses a risk to private property rights which is the primary basis on which South African agriculture is structured. Consequently, the Bill poses a risk to agricultural sustainability and food security. Therefore, AgriSA is committed to defending property values and rights and will utilize all necessary resources in consultation with legal experts to uphold these principles,” says Johann Kotzé, AgriSA CEO. AgriSA actively participated in the NEDLAC and parliamentary processes from 2013 to 2020, contributing to the 2016 Expropriation Bill that formed the basis for the recently signed legislation. On April 29, 2024, AgriSA addressed a letter to the President, urging him to consider exercising his constitutional powers under section 84(2)(b) and (c). The organization requested that the President either refer the Expropriation Bill back to the National Assembly for reconsideration or consult the Constitutional Court for a decision on the bill’s constitutionality before signing. In its letter, AgriSA highlighted its commissioning of an independent investigation into the macroeconomic impact assessment of a policy of land expropriation without compensation in South Africa conducted by GOPA Group South Africa (Pty) Ltd. “This assessment reiterated AgriSA’s long-held conviction that fostering capital formation is interlinked with private property rights and is subsequently a crucial prerequisite for economic development, job creation, and growth,” says Kotzé. “While supporting the need for transformation and land reform in the agricultural sector, AgriSA emphasizes that it must not come at the expense of the economy and investor confidence, added Kotzé The organization remains dedicated to protecting private property rights and fostering the growth and stability of South Africa’s agricultural sector while ensuring food security for all. AgriMP verwelkom appèlhof uitspraak insake weidingsregte

Die MoladoraTrust v Mereki en Ander saak het gehandel oor weidingsreg, al dan nie, ingevolge die Wet op die Uitbreiding van Sekerheid van Verblyfreg 62 van 1997 (ESTA), op die eiendom waarop verblyfreg gevestig is. Aangesien die oorspronklike uitspraak verreikende gevolge vir ons lede ingehou het was AgriMP dus deurgaans ten gunste daarvan om die appèl te ondersteun. Op 3 April 2024 het die Hoogste Hof van Appèl uitspraak gelewer in die Moladora Trust v Mereki en ander-saak. Die appèl is deur die hof gehandhaaf. Die plaasbewoners is beveel om onmiddellik al hul vee van die applikant se plaas te verwyder. Die Appèlhof het sy bevindinge gegrond op die Adendorff Boerdery v Shabalala en ander [2017] ZASCA 37 para 28; Loskop Landgoed Boerdery (Pty) en ander v Petrus Moeleso en ander [2022] ZASCA 53 para 14, waar dit bepaal het dat die reg van ‘n okkupeerder om vee op ‘n ander persoon se plaas of grond aan te hou of te bewei, nie ‘n reg is wat uit ESTA spruit nie, maar wel ‘n persoonlike reg wat spruit uit toestemming tussen die okkupeerder en die grondeienaar of persoon in beheer. Die okkupeerders is verder verbied om, sonder vooraf toestemming van die applikant, vee op die plaas aan te hou. Die hof het elke party beveel om hul eie regskoste te betaal. Die gunstige uitkoms van hierdie saak word deur AgriMP verwelkom. Hierdie uitspraak behoort die verkeerde interpretasie en toepassing van die ESTA wet te voorkom of ten minste te beperk.Lede word aangemoedig om geldige ooreenkomste met plaasbewoners, wie oor verblyfreg gegrond op ESTA wetgewing beskik, in plek te stel sodat onnodige toekomstige regskoste vermy kan word. AgriMP welcomes decision by Court of Appeal on grazing rights

The MoladoraTrust v Mereki and Others case dealt with grazing rights, whether or not, in terms of the Extension of Security of Tenure Act 62 of 1997 (ESTA), on the property on which tenure has been established. As the original ruling had far-reaching consequences for our members, AgriMP was therefore consistently in favour of supporting the appeal. On 3 April 2024, the Supreme Court of Appeal delivered judgment in the Moladora Trust v Mereki and others case. The appeal was upheld by the court. The farm dwellers were ordered to immediately remove all their livestock from the applicant’s farm. The Court of Appeal based its findings on Adendorff Farm v Shabalala and others [2017] ZASCA 37 para 28; Loskop Landgoed Boerdery (Pty) and others v Petrus Moeleso and others [2022] ZASCA 53 para 14, where it was determined that the right of an occupier to keep or graze livestock on another person’s farm or land, is not a right arising from ESTA, but a personal right arising from consent between the occupier and the landowner or person in charge. The occupiers were further prohibited from keeping livestock on the farm without prior permission from the applicant. The court ordered each party to pay their own legal costs. The favorable outcome of this case is welcomed by AgriMP. This judgment should prevent, or at least limit, the incorrect interpretation and application of the ESTA law.Members are encouraged to put valid agreements in place with farm dwellers, who have right of residence based on ESTA legislation, so that unnecessary future legal costs can be avoided.
